Consumer Goods and Retail

The value of our consumer goods and retail sector comes from offering commercially sound advice across the full range of legal issues affecting those participating in these markets in Kenya.

Companies operating in today’s global consumer goods and retail sector must adapt to an increasingly competitive environment and at the same time navigate a complex array of regulatory requirements. Understanding and complying with these requirements is an integral component of strategic growth, from research and development through to manufacturing, marketing and distribution.

IKM is involved at every level of this sector, from producers of raw materials to manufacturers and transporters. We are positioned to guide companies through the specific legal and regulatory challenges of the food and beverage sector, advising companies on legal issues such as regulatory compliance, intellectual property, franchise agreements, environmental impact, waste management and recycling, and advertising.

Experience has included advising:

  • Compagnie Gervais Danone in its acquisition of a 40% stake in Brookside Dairy Limited, one of the leading dairy companies in East and Central Africa with subsidiaries in Uganda and Tanzania

  • A leading beverage manufacturer at the Supreme Court of Kenya in a dispute over the distribution of beverages by Kenya’s leading beer manufacturer. The indicated value of the business under controversy is about USD30 million

  • East African Breweries Limited in reviewing a proposed law affecting the beverage manufacturing sector in Kenya

  • Represented a major retailer in Africa on a matter that related to competition law, comparative advertising, brand disparagement and consumer protection

  • A leading international beverages company and other international brand owners in the registration of trademarks in various jurisdictions across Africa including Kenya, Uganda, Tanzania (both mainland and island), Rwanda, Burundi, Ethiopia and South Sudan
