Key experience

  • Represented an oil company in arbitration where the oil company was seeking to recover damages to the sum of US$14 million against a supplier for failure to supply automotive gas oil within the agreed delivery period (or at all), forcing the oil company to source the product from an alternative supplier at higher costs and thereby making losses. The court recognised the award and directed that the same be enforced as a decree of the court.
  • Represented a top bank in a suit challenging the government’s decision to place a caveat over a property charged to it, effectively barring the bank from realising a debt valued at approximately US$7 million.
  • Represented a telecommunication company in a matter where the company was challenging attempts to refer a dispute to arbitration on the basis that an offer to pay made during ‘without prejudice’ correspondence, be enforced because there was in the circumstances no dispute capable of being arbitrated upon.
  • Defended the Independent Electoral and Boundaries Commission in an election petition seeking to overturn the results of a parliamentary election. The decision of the High Court was upheld on appeal.
  • Represented clients in matters before the Public Procurement Administrative Review Board in which the clients were challenging the procurement process. Milly also assisted a Senior Partner in successfully challenging the award of the laptop tender to a client’s competitor before the Review Board.
  • Represented various institutions in defending claims related to Employment law, including work injury claims and wrongful dismissals.
  • Represented various banks in debt recovery matters - both in court and arbitration.
  • Assisted a Partner in defending a client seeking compensation from the government for the illegal demolition of its properties to facilitate the construction of a major highway in Kenya. The value of the subject matter was approximately US$8 million.
  • Appeared for the Independent Electoral and Boundaries Commission and its Chairman before the Supreme Court of Kenya in the petitions that resulted from the March 2013 presidential elections.
  • Represented a client in a dispute involving the refusal by the Kenya Revenue Authority (KRA) to pay VAT refunds on grounds that it did not have funds. The court issued an order of mandamus and directed KRA to pay the client approximately US$421,686 owing for the VAT refunds.
