Diana Ogula is a Senior Associate in the Dispute Resolution practice at IKM. Diana has more than nine years post admission litigation experience. She has advised and represented a diverse portfolio of clients before various courts and tribunals. Her main areas of practice include commercial litigation, criminal litigation, constitutional and judicial review litigation, real estate disputes, public procurement, defamation, family law, and employment disputes. Diana has actively participated in high profile arbitration proceedings before local tribunals.

  • Assisted counsel in a construction related dispute between a leading contractor and a government agency where the claim was in excess of Kshs.4 billion.
  • Assisted counsel in a dispute between a local authority and a private company involving a street lighting project.
  • Assisted counsel in a land dispute between a government agency and a private company.
  • Defended successfully a Judicial Review application seeking to quash the results of an investigation and to stop criminal proceedings from continuing before the Magistrates court.
  • Defended successfully a constitutional petition by police officers seeking to stop their arrest and arraignment in court to answer to corruption charges.
  • Obtained injunctive orders prohibiting the transfer, alienation and/or dealing with a prime parcel of public land located along Waiyaki Way, Nairobi which had been illegally alienated.
  • Obtained orders preserving a public playing ground which had been illegally alienated.
  • Involved in various disputes in respect of claims arising from the double allocation of land, recovery of alienated government land and landlord/tenant disputes.
  • Assisted counsel in the successful criminal defence of former heads of parastatals and government agencies.
  • Formed part of the team that conducted investigations into the embezzlement of funds meant for the construction of a dispensary by public officers which led to the recovery of the monies which had been embezzled.
  • Formed part of the team that conducted investigations into the illegal alienation of a public playing ground by an individual which led to an order being issued preserving the said property.
  • Formed part of the team that conducted investigations into the irregular procurement of motor vehicles by an institution of learning which led to the arrest and arraignment in court of the suspects.
  • Formed part of the team that conducted investigations into procurement irregularities by officials of a Roads Tender committee which led to the arrest and arraignment in court of the suspects and cancellation of the tender.
  • Perused and evaluated evidence in investigation files to determine the sufficiency of the evidence to support the above criminal prosecutions.
  • Compiled comprehensive investigation reports to the Office of the Director of Public Prosecutions in various matters touching on corruption offences with recommendations for prosecution of persons for corruption or economic crimes.
  • Prosecuted and defended various disputes arising from employment and labour-related claims.
  • Assisted counsel in a matter before the Public Procurement Administrative Review Board and later the High Court challenging a tender for the supply and delivery of syringes to the Ministry of Health.
